ADRF App Terms and Conditions

These Terms of Use (“Terms”) govern your access to and use of the ADRF NPC website, the ADRF App, and related online services operated in connection with the Africa Diaspora Revival Fund (“ADRF”).

By accessing or using this website or the ADRF App, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree with these Terms, please do not use the website or ADRF App.

1. Acceptance of Terms

By accessing or using the App, you agree to be bound by these Terms and any additional terms and conditions that may apply. If you do not agree to these Terms, you must immediately uninstall and discontinue using the App.

2. Changes to the Terms

We may update these Terms from time to time. When we make changes, we will update the “Last Updated” date above. You agree to review these Terms periodically. Your continued use of the App after any changes are made constitutes acceptance of the revised Terms.

3. Eligibility

To use the App, you must be at least [age] years old and have the legal capacity to enter into a binding agreement. By using the App, you represent and warrant that you meet these eligibility requirements.

4. User Account and Security

You may be required to create an account to access certain features of the App. You agree to:

• Provide accurate and current information.
• Maintain the security and confidentiality of your account credentials.
• Notify us immediately of any unauthorized use of your account.

You are responsible for all activities that occur under your account.

SMS Opt-in Message

By creating an account, you authorize ADRF to send text messages or One Time Password (OTP) to verify or authenticate you when signing up or logging into the ADRF App. ADRF may also send you offers and other information about the ADRF App. Message/data rates apply. Consent is not a condition of purchase.

5. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates any applicable laws or regulations.
• Engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the App.
• Attempt to interfere with the proper working of the App, including introducing viruses, malware, or any other harmful technology.

The ADRF App is owned and operated by Africa Diaspora Revival Company Pty Ltd and is used by the ADRF NPC for donations and crowdfunding activities.

6. Intellectual Property

All content, features, and functionality of the App (including text, graphics, logos, and software) are the exclusive property of Africa Diaspora Revival Company Pty Ltd and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, create derivative works from, publicly display, or commercially exploit any content from the App without our prior written permission.

7. User-Generated Content

You may be able to submit content to the App, including but not limited to text, images, and videos (collectively, “User Content”). You retain ownership of any intellectual property rights that you hold in the User Content, but you grant us a worldwide, non-exclusive, royalty-free, and transferable license to use, display, and modify the User Content in connection with the operation of the App.

You represent and warrant that you have the rights to submit any User Content and that your User Content does not violate any laws or the rights of any third party.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and share information. By using the App, you agree to our Privacy Policy.

9. Third-Party Links

The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

10. Termination

We may terminate or suspend your account and access to the App at any time, without notice, for any reason, including if we believe you have violated these Terms.

11. Opting Out and Account Deletion

You may opt out of using the App at any time by either:

• Deleting your account: You can delete your account directly through the App’s settings. Once your account is deleted, your information will be removed from our systems in accordance with our Privacy Policy.
• Requesting account deletion: You can also send an email request to [info@adrffoundation.com] to have your account and data deleted. Please include your account details for verification. We will process your request within 14 business days, and confirm once your account has been fully deleted.

12. Disclaimers and Limitation of Liability

The App is provided “as is” and without warranties of any kind. To the fullest extent permissible by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event will we be liable for any direct, indirect, incidental, or consequential damages arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.

13. Governing Law

These Terms shall be governed by and defined following the laws of South Africa and yourself irrevocably consent that the courts of South Africa shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
